Seems a bit excessive to me. In no way should they have jacked this guy in the head with a club. If this was a white cop beating a black drunk guy, **** would on CNN by now.

If you are drunk in Russia, cops (we have two kinds, traffic and the other) talk you into coming with them. You can yell at them, call them names, they won't use batons on you, or taze your ass, or shoot you. They can jump you if you put your hands on them thought. Youtube is full of these vids.

yelling is one thing, battery (laying even one FINGER on another person) is another thing, entirely. Verbal assault is a misdemeanor, battery is a felony.Commit felony battery on a cop, buster, you can EXPECT violent consequences. I think you are correct in regard to the letter of the law as it relates to the speech itself. It's the shove, scream, and lunge move that justifies the use of at least some level of force. The club to the back of the head was likely excessive, though. They should have just cuffed and arrested him without using the club.

His poor choice of words relates more to the unwritten human element of the law. A jury in Mississippi is going to be about 50% elderly black people who still remember the civil rights era when white cops treated them that way. Good luck getting that jury to convict.
