Yes it would be legal in certain circumstances. Just because you don't like a certain government action, does not necessarily make it illegal. If surveillance could arguably be for national security purposes consistent with FISA and other federal statutes, then yes in fact it would be very legal indeed.

Obama staged all of this because he knew the outcome would be no war. Just as I suspected, when he said he would "go to congress", he retreated from the war. He knew full well Congress would vote NO. Then he would be able to say he tried, and it will be the end of it.

This is a tanget, but this thread got me thinking about it. I live in the midwest. A few summers ago some friends and I did a weekend tour of empty Atlas and Titan bases over in Kansas. Were able to get inside a couple of them after sneaking onto someones farmland. It is very creepy, to see the big empty silo where the missile stood now full of water and trash, and the big blast doors. And the living quarters and control room was circular, and was sitting on top of the biggest spring I've ever seen, so it could absorb the shock of a blast. There are google maps and coordinates of these sites. I wonder what the size of our nuclear arsenal is now.
