Not sure if anyone has been following this trial on Court TV and socials but Hawaii doctor (Gerhardt Konig) was found guilty today of attempted manslaughter due to extreme mental/emotional disturbance (prosecution was going for attempted murder).
Jurors believed the relationship Arielle Konig had with a coworker was sufficient to cause "an extreme mental emotional disturbance" and this affected their verdict.
Under Hawaii law, if jurors believe a defendant committed attempted murder but was under the influence of an extreme mental or emotional disturbance at the time, they must reduce the charge to attempted manslaughter if they believe there was a reasonable explanation for the disturbance.
Basically his wife had an affair with a co-worker, tried to cover it up (deleted text messages etc), husband found out and completely lost his shyt while on a hike with her after she said.she would be seeing co-worker Monday morning.
They had a fight, she fell, he was on top of her with a rock hitting her several times in the head which required stitches but no concussion or brain injury.
He faces up to 20 years in prison.
Likely sentence - 14 years. Out on parole in 10-12 or less.
Thoughts?
