speeding ticket out of state (lawyer juans get in here)

So I got a speeding ticket out of state (Iowa)
it was considred a "serious violation" paid the ticket, cause it was 12 hours away where I lived
next thing I know their trying to suspend my license in Iowa (I don't live there though). COme to find out they can also suspend my license in minnesota

long story short I appeal it twice, then did a "phone hearing" with a judge last month. I thought it went very well, I even had my employer send a letter on my behalf. I was very polite to the judge and apologized profursely

He said he would send me a letter with his decision

IT's been a month, and I just called the judge again says the letter's been send off

What are the odds that my license has been suspended?

I know you're anxious, but all you can do until you get the letter is wait. There should be an appeals process if the decision goes against you. In my state, you would pay a lawyer at the state capital to represent you in the appeals hearing. The important part is "pay a lawyer." I grew up with one of the few guys who does that work in my state. His biggest skill is flirting with the women at the courthouse, which is what makes him such an effective attorney.

but why would it take him a month to make his deicison?

surely a speeding ticket may not be high on his priority list so why wait so long though?

im sorry bible just nervous, a suspended license could eff up a lot of stuff for me, espeically my livelyhood

They are probably just underfunded and behind. Most states are broke.

They also have the prerogative to wait as long as they want. Under the Constitution, you would normally have the right to a speedy trial and also an attorney if you could not afford one. But that's only for criminal punishments that might put you in jail. They consider taking your license away to be an administrative action, not a criminal punishment. That means you have no rights. Your "judge" or prosecutor might not even have a law degree. That's part of why paying a real lawyer to represent you will get you a tremendous advantage. Your lawyer will understand the extent to which you have no rights, and that the best way to advance your interests is to flirt with the right secretaries in the right office. Even if you found those women and tried it yourself, I guarantee they would be complete b!tches to you.

Good luck with everything. One thing to remember is that as a defendant, time is on your side. Every day that passes is one in which you can at least still drive, work, and save money to pay your lawyer.

They can suspend your driving privileges in Iowa but I doubt it would likely mess up your ability to drive in MN with some exceptions like DWI's and vehicular manslaughter. You say serious but I doubt that serious. As far as I know, the only state in your area that did not sign the Non-Resident Violator Compact is Michigan, so your home state's DMV can disclose information of your driving record with Iowa.--Trap
 

What happens, IN HER MIND, is that she comes to see you as WORTHLESS simply because she hasn't had to INVEST anything in you in order to get you or to keep you.

You were an interesting diversion while she had nothing else to do. But now that someone a little more valuable has come along, someone who expects her to treat him very well, she'll have no problem at all dropping you or demoting you to lowly "friendship" status.

Ok guys so some good and bad news here

Good news I got the letter I guess :nervous: and they rescinded my suspension, however my licensee will be on probation for a year :down:
soooooo it means I gotta keep my head clear

Now I'm weighing 2 options

Options 1--keep my head low, do the probation, and then have it expunge

or options 2--get a lawyer and try to appeal it again for what it seems like the 10000th time

I'm leaning more towards option 1 just because right now fincianilly option 2 would be tough with me just getting this new job and trying to get fincially back on track

thoughts?

Just do the probation, man. But take it seriously. You don't wanna mess with that.

Or extend your vacation in the Chi and you wont need a car at all haha

Hang in there.

Judges can be bigtime slow. They take forever on simple motions, motions in limine, discovery, everything. What's really frustrating is that you may have a motion filed with the court that you think you most certainly will win and the POOF! Judge fvcknut just bent you over! :eek:

You'll be ok.

What BB said. Take the probation and drive superbly. Treat is like a "prayer for judgement." Because that's basically what they've given you.

I would do as Bible suggested but I would also minimize my driving time as much as possible. Cops can pull you over for anything from a busted tail light, not using your turn signal, seeing a light on in your car that looks like a cell... they could just be in a mood and make something up.

I am in month 4.5 of a 6 month suspension for an in state speeding ticket and it's been the biggest pain ever. You didn't mention the details of your probation but I have a feeling you're going to be strung up the @ss pretty good if you violate it.

I hired a very good attorney, the best I could find, and he got me down from a 2 year suspension and a criminal charge to nothing but 6 months. He advised me to not even apply for driving privileges because all it takes is one bad/p*ssed off cop to mess things up. Food for thought.
