Not buying it.

He's got numerous ways to bust her, but didn't. Either this guy is a raging AFC and still thinks he and his wife are getting back together, or he's a complete moron. If he can't tie up his loose ends, maybe he deserves for something like this to happen to straighten his ass up.

His lawyer sucks. He should have sued her, not the company. To rule against the company would be to say they had to pay the money out twice, which is a windfall for the wife.

He should still be able to bring a suit against the wife, after he pays his crappy attorney more money, or hopefully gets a new one.
