What do you guys think about prenups? Should the wife get any alimony in case of divorce? Should she get anything when she gets older and the man wants to upgrade to a younger, sexier model?

I read Kim K gets $1M per year upto $10M and waives any right to Kanye’s future earnings.

I think that’s ridiculous. If the woman is going to get paid $$$$ per year, why would the woman ever ever be NICE to the man? She’s going to be paid anyway. Go travel and go sleep with another guy behind his back. Then put on an act when you with him.

I’m curious to hear thoughts.

Just about any terms can be negotiated in creating and signing a binding prenup agreement. However, that does not mean a court will uphold and enforce it down the road.

There are certain criteria that must be present in the agreement for the court to enforce it when the time comes. A judge must consider it to be fair to both parties, meaning it doesn’t favor just one person while the other gets nothing. It must also be a contract that can withstand any claim that one party was under duress/pressured at the time of the creation and signing of it.

In the Kim example you cited, Kanye’s prenup is far more likely to be upheld in court vs a prenup in which Kim gets nothing. In the case she would get nothing in the agreement, the prenup will be far more likely overturned and she would ultimately end up with half his fortune as if it were a regular divorce without a prenup contract.

The more you think a prenup is supposed to leave a b*tch with nothing as you walk away with your riches, the more likely you’re going to find yourself fvcked like a fool.

Prenups are contracts, and a contract is only as good as the lawyer who wrote it.

I also can’t give YOU payout if YOU want a divorce because you will have no reason whatsoever to be nice to me while we are married. Your eyes will be on payout.’’

Woman: “I love you too. But I expect $50,000/year just to be your wife or a sum of $250,000 after 5 years. I don’t have to do anything. I don’t have to bring children. And technically I don’t have to treat you nice because will sign that contract that you have to pay me whether I’m a bvtch or not. And I know I can cheat and treat you badly because the courts on my side since I can use my emotions to influence the judge/the court/ and society, and the fact you signed.’

My point of a prenup is: the man and woman start from ZERO and NO payout if there NO kids because she will have NO reason to be nice to you while you have a legally binding contract in place.

Regarding alimony, my state (IL) recently switched to a statutorily guided alimony structure. At ten years, mandatory alimony kicks in if there is much discrepancy in the incomes of the two sides. At 20 years, the mandated length of alimony is set as equal to the duration of the marriage.

The best defense of prenups is not to get married. They can get thrown out in court and I've read about this happening with the judge siding with the woman because she would claim she didn't know what she signed. That's why you have to have two lawyers. One for her and him and then for those 2 lawyers to work together on both behalfs. However, why bother? It could even be thrown out in this case also. Don't get married. Easy solution.

I think knowing about prenup options is important but also what are the laws in your neck in the woods with regards to marriage, common law and child support. This stuff is online now so really no excuse to not look it up. There is no exception to the rule regarding women. Women will always put the best face on before you marry them or live with them. I've done neither but I learned from the best. Tom Leykis and I took it from there and looked stuff up online.
