Police domestic abuse etc

So I remember a friend in California telling about how his wife claimed false accusations of domestic abuse around the time they got divorced. She dropped the charges but it did appear on his record and he was jailed for a night or two or something.

How does that work in family situations, I am kicking out some family from my apartment and am concerned about false charges of anything really that might get me removed from my apartment. I am the leaseholder. The people in question are cousins, all older than me, both female, their parents. And the older cousin has a husband and a kid.

How can I make this a smooth process I am a college student working towards getting into medical school. I'm also dealing with thyroid issues so as less stress as possible is great unless I want a heart attack or to have panic attacks for days.

I'm in Virginia.

Witnesses are a good idea if you have to go see them, but you don't have to do that to evict them. Double-check VA laws, but here in IL 30-day notice can be delivered via certified mail, then you can serve them with the eviction notice, which has to be done with a process server anyway. The only time you would ever have to see them would be if they try to fight the eviction and show up in court.

Bible Belt is correct or have your landlord do you a favor and asked them to leave since they are not on the lease.
If they are not on the lease then ask your landlord to boot them. Let him be the bad guy while you give them empathy as they pack and move.

Your lease should state who is entitled to live there. When I do a lease all of the adults are listed by name. Children are listed as minors.

As a landlord myself I would have already booted them out.

The law is going to give you a process to kick them out, but it will take a month or two. The hard part is getting them to not trash your place before they go, and the law can't help you with that. Probably putting up cameras everywhere is your best bet, not that they won't try to break those, too. I would spend time away from home after that if at all possible.

Have they been there so long that they now have legal rights to a "proper" eviction process?

You would be surprised at how short of a time it takes to meet that requirement. At this point, I would assume all of them do.

They have helped me with rent, I'm filling an eviction, they've been here for about a year and are listed as occupants on the lease. It shouldn't take long, the threat of having an eviction on their record should make things move along.

I'm not worried about the eviction my concern it false accusations like rape, abuse, violence, etc etc
