it was either come here and type out my fustratinon or curse a client smooth out so you guys are going to have to bear the brunt of my fustraiton

i sold my business about 3 weeks ago, but i still have to handle all of the jobs i had signed up, that's part of the deal. there is one job i signed a contact for on may 12th.. may 12th, the guy still has not paid a ****ing deposit for the job.

this is not a small job it's a $4,750 dollar project considering this guy is stroking me like a ****, there is no way i am starting on it, without him paying a deposit. to add, he's black and while i'm black, i have already more than once, posted my disklike of workign with people th same color as me. call it racist, call it whatever the hell you want, i dont' give a ****, but most don't get "it". there are certain things you dont' do in business and i'm trying my ****ing best not to lose my cool... this guy is preventing me fro doin a lot of tings like not work lol. he is the sole reason i'm not 100% done with my job and it's pissing me off.

so, we sign the contract i send the invoice, and he doesn't respond for 2 weeks, then he says okay we are going to go ahead he had to get funding in order. it's not a small project, not a horribly big one. i have to adit, the deposit is 1,500, i am leery about people who do not have... business people, who do not have 1,500 laying around. that's not a hell of alot of money. but i digress, it is what it is.
so the guy tells me he is getting funding here taken care of, i say okay so i tell my grahpic guy hey , don't work on anything because we are starting this in the next 2 days, it's a big project (For him it is). guy doesn't respond. gives me some BS about his check having to clear.

this **** really takes the cake right here. last week he tells me he is going to have the money in his hand on monday this week. i was planning on going new jersery last week but if were starting this project, i wanted to be in town to make sure everything gets taken care of.

so monday i shoot him an email and he tells me it will be today. i'm agiggated but 1 day is not that big a deal.

then i call him today and this ***** has the nerve to tell me to be patient. i damn near lost it. it took everything in my power to say okay just keep me updated and hang up the phone.

then he emails me and he has a family emergency and has to go out of town for a few days.

this guy is never going to pay this deposit. it's not even the money nor is it the job at this point i would be happy to say **** it all. but it's not just about me, if it were just about me i would have told hi to **** off a long time ago. his job is going to keep 3 different people busy, that's work for 3 people and it would be very selfish of me to say **** you guys. plus, i spent about, 25 hours so far securing this project, i don't' want my time to be in vain.



it's people like this, just no ****ing respect for other peoples time, no respect for other peoples businesses, that piss me off more than anything. what the **** was the point of telling me you were ready when you weren't? hell iuf you would have just told me it would be another month i would have packed up and went to NJ and been happy.

this is what i mean by everyone wants to be a small business owner, yet no one wants to actually run a business, no one wants to be accountable, no one wants to think about other people. pisses me the **** off.

it's ***** *******s who think like this which is why i don't want the avg "guy" and his ****ed up selfishness and lack of consideration for others around me.

men sit here for ****ing days, weeks, months of their lives wondering why they have no women, wondering why women don't like them and talk about how women are ****ing horrible, hell the mothher****er probably is a member here lol, yet turn around and does ***** **** like this to another guy. you talk about a woman having no morals, then you turn around and dont' have any, and want to complain.

It sounds like even if you get the deposit and do the work you're gonna have a heck of a time trying to get the rest of the money.... Might be better just to walk away.

something in you is causing him not to pay, it could be the fear of not being paid or the regret and frustration of having to do the job. Let go of the fear and the regret and the check should be on the way. :)

Sometimes sh*t just happens and we are not responsible for it. The world is rife with pricks who will screw you over whether you have good intentions or not. That's the cold hard reality, especially in business.

backbreaker, I've had to deal with clients like this before and let me tell you it is rarely worth the stress to do business with them. Even when the deposit is paid, you can count on more disregard for your time when the project is started (requesting things that weren't in the estimate, unrealistic deadlines, rest of money takes MONTHS to come through etc)

Unless you are starving right now I'd pass on this one.

Why would you sign a contract without getting the deposit first? That does not make sense. That's what a "deposit" is - money that you get paid before you start working.

And you don't ever seem to want to sue anybody. Being litigious is an asset. Once you've sued once, it gets a lot easier, because you just change the names and use the same complaint over again. Do everything yourself so that you don't spend money on an attorney.

1. that's the thing. i sent the invoice with the deposit, that is normal operating procedure, then all this **** about him gathering funds cropped up.

2. no i don't not really. it's not worth my time or effort. It's a milestone based project, the only thing i could get is the deposit which is $1,500, my time is not worth $1,500 for the effort that i would have to put into it, at all. $15,000, maybe. $1,500 hell no.

Also, I am a firm believer in never doing anything to someone that you would not want them to do to you if the positions were reversed. I'm not broke, i don't need the money and it's obvious the guy is just in over his head. That is not a suing matter.

Last but not least, I had my suspicions all along about this guy and i blame myself for wasting the time and the effort into getting him.

I've sued before, my first company a company tried to jip us when we were int eh venture capital phase, we paid $8,000 for some marketing materials that never came that they were suppose to mail out to investors. At the time we needed the money at the very least so yes we did sue. We got our money back in 3 installments.

There are two reasons i have not dropped this project. 1. Even though I sold the company or leased it, I can still use our portfolio for my next venture (which is going to be simply a more niche versus of this company) and this particular project is extremely unique it involves something that can open alot of doors. It also involves print work for magazine ads, something my graphic guy has done but not something that we hve done before as a company. So I that is in the back of my mind as well.

I blew off one prick of a client about 6 months ago for a $12,000 dollar project, the money didn't piss me off but the idea for the site was truly, unique, and i regret that and if he gets it built it is no doubt in my mind it will catch on.

If this were some generic mom and pop e commerce site i would have dropped him but it's not, not even close. I always try to improve our portfolio and this would take our portfolio ahead 2-3 steps.

so with all that in mind, patience is a virtue and I needed to just vent more than anything. I am emotional, event though I don't show it to the person that I am getting emotional about, at times i just have to let it out. Generally i just vent to my fiancee but she was getting her hair done and was going to be a while so i just let you guys have it

because i don't want to do it anymore. It's no longer exciting, I started the business for 1 particular reason and I have achieved that reason, now it's time to take a break and move on.

I have a **** load of things I am going to do, but one thing is I wanted to do is try to get a corner on the equine thoroughbred industry web development market. quite frankey the industry is lacking and I know with a strong portfolio we can go in and make a real dent, but I could not do it with out the right portfolio which I now feel we have. So I"m going ot take a few months off, re build our own website to make it more equine centric, build a few sample equine related websites to show off what we can do for that particular niche, I have a social network that i have been working on and I am at the very least get started on that, and I'm more than likey going ot be taking a pretty big road trip next year hitting most the country.. but basically take a break.

I didn't sale it I basically leased it out so I can draw the income form the business, and in turn train the guy who I leased it to for a percentage of profits plus a flat fee per month. In turn I am still able to use the portfolio. It's a pefect setup.

update


guy calls me on Monday tells me that he will send a cashiers check early next week. I had already decided I am not doing business with the guy. I know he isn't sending the money, but he has this need to convince me he is. it's odd. anyway this is what I get

Monday
me and my people have signed off and will send the check next day air tomorrow to the address on your invoice

Tuesday
i sent my business partner out to distribute checks, my lawyer just called and said he got his, so i will let you know when I get confirmation
he still aint back yet man, and his phone is dead, so its prolly died. once i hear, I'll let you know

Wednesday:

my business partner was delayed. He got glass stuck in his foot, not sure how or what happened, but he's at home drooling off of pretty intense pain meds after the doctors cut it out his foot. I will go pick up the certified bank check today and send it out. and will shoot you confirmation. everyone has already been paid, but you should have been paid first, so when he's better, we are all having a lil meeting on priority management.

expect to hear from me this evening
And of course, did not hear from him last night. I don't see why he just doesn't say hey man i'm broke. I don't even pay him any attention anymore, he's talking to himself now.

This was something I saw in the business partner I had as well; all talk and no action. eventually it becomes noise you ignore and want nothing to do with.

holy crap. lol, let me tell you what this guy did. dude, went to ups.com and used the print your own label option that gives you a tracking number, sent it to me and told me the package was shipped lol. like i can't freaking tell that all you did was print a label. this dude is classic.

i'm going to update this situtation.


he eventually did pay. against my better judgement i took the job.

the first milestone, we hit in 3 weeks. would have been half that had he actually been responsive.

so, milestone payment time comes, he pushes me back another 3 weeks. then, he only sends like 60% of the agreed upon milestone, then begs me to do keep going to h can get his money, then pay us. AI said no, that's not part of the contract.

I put in all my contracts, matter of fact, here is the terms right here

that does not state, that if i do not like you, i can get a refund. it stats that if the site does not function like i said it would function i will refund all your money. so the guy tries to use this now, to get all his money back, after we have done the work, that he approved by paying or trying to pay the milestone.

i thought about even taking it to court. i hate people like this. but i thought about it and it's no different than ****ing a girl you knew you should not have ****ed, in the end, i knew better than dealing with him. i knew itw as not worth my time and i looked past the red flags, so i sent him back his money and wished him luck.

Well, I don't want to hijack your thread so I wont rant here, but I'm glad to know that if I did want to rant, this forum has a place for it.

I'm also glad that you did decide to rant here rather than do something out of anger in the "real" world.
