I sell things online, including very cheap wholesale ipods. Recently I sold "intellectual property" to am an online. It was information on how to get these Ipods for very cheap. For this, he agreed to pay me $3000.
He had no way to pay me, except by credit card. Because he was canadian and I am American, I couldnt process the card without getting a different, more expensive merchant account. So instead, he agreed to let me use his card (which of course, would only work online because i only have the # and name) to purchase goods until I ran up a total of $3000.
So I began, and purchased a safe on Amazon.com . After everything, the total came to $425 and I approved it. After I approved it, a day passed and it became too late to cancel. It was at that point, that he Instant Messaged me to tell me he wants to cancel (even though he already received the secret to getting the ipods). It was too late for me to cancel the payment, and I just received the safe today.
Keep in mind that I had no record of giving him the information. I recently emailed him the information, that way I would have record of it. Also, the only record I have of him willingly giving me his credit card information and allowing me to use it is Yahoo messenger archives. These archives could easily be edited, so I doubt they would hold up in court.
I can't give him back the money, as I would be in the hole. Now that he canceled he refuses to acknowledge that he allowed me to do this, though he doesn't say he didn't allow me to.
So basically, if the IM records wont hold up, and he can legally sue me then I'm screwed. There would only be record of me using his credit card number to buy stuff for myself (a minor). Keep in mind I can't return my safe and I can't just reimburse him for it either.
So here are my questions:
1) Is yahoo chat archives and emails enough record of this transaction?
2) He is Canadian, I am American. Can I even get into legal trouble over this?
3) Maybe I can't get into legal trouble over this, but can he damage my credit or reputation with the credit card company (VISA)?
