Why did she date this ******* in the first place? If you're going to have her, he needs to know he has no chance anymore, so it would have to be official between you two. Otherwise he'll bring friends and beat you with baseball bats.
He's crazy, she must have some crazy in her to have dated him. Find a new girl to avoid more drama. She likes you more than him, but enough to date you? I don't think so. Rejecting the kiss is a really bad sign.

Dude, what Judge nismo got out of reading that big ass wall of text was that she's not over her ex and is still wet for him. She dries up for you.
Also, women who are interested in you won't confuse you. This was doomed before it started. All this drama.
My ruling is drop her ass and spin more plates. She's giving you mixed emotions and rejecting your kisses. But she doesn't mind your attention! All bad signs.
