It ruled that while Doe likely was “blacked out” during the oral sex, “being intoxicated or impaired by drugs or alcohol is never an excuse.” Since AS [the female] said she withdrew consent at some point during the sexual act, and since Doe couldn’t challenge that recollection, the panel was at least 50.01 percent inclined to believe the accuser’s tale.

In order for a crime to be committed two things need to take place :
Mens rea and actus reaus.

Mens rea is the means to commit a crime. It is the intent part of the crime


Actus reaus is the action part of the crime.

In this case an unconscious man can not have mens rea.

This is a college board though, not a court of law. Funny thing is, if the woman was unconcious instead of him, it would still be rape. You can't win.
