MADRID, Spain—A speeding motorist who killed a teenage cyclist is suing the boy's parents over damage to his luxury car, the government says.

Enaitz Iriondo, 17, died instantly in August 2004 when businessman Tomas Delgado's Audi A8 crashed into him at 100 mph near Haro in northern Spain, an Interior Ministry traffic report said. The speed limit was 55 mph.

Iriondo was not wearing reflective clothing or a helmet, the ministry report said. As the sun had set when he crossed the path of Delgado's car from a side road, a regional court found both parties at fault and closed the case, the report said.

Delgado, whose insurance company paid Iriondo's parents $48,500 in compensation for their son's life, filed a suit in late 2006 to recover $29,400 in damages to his car and car rental costs, the ministry traffic report said.

"It's the only way I have to claim my money back," Delgado was quoted as saying by the newspaper El Pais, which first reported the story on Friday. El Pais said a ruling was expected next week.

Iriondo's parents were shocked.

"It's the final straw, a stab in the back," Iriondo's mother, Rosa Trinidad said, according to El Pais. "Before the lawsuit we thought the poor guy would find it hard to live the rest of his life with the thought of having caused our son's death.

The European Union's statistics office says Spain recorded 113 traffic fatalities per million inhabitants in 2004. The average for the 25-nation bloc was 95. In 2006, 3,016 people died on Spain's roads.

Sorry to comment hi-jack, but this has happened to me before. I was about 10 years old on a bike crossing the street. I was in the middle of the intersection waiting to cross when a driver in the left lane was stopped and waved me to cross the road. Halfway across the road I was struck by a car and destroyed the windshield and scratched the front with my bike. I was okay and all I had to get was a few stitches on my back from the glass. Two weeks later I had a court order for the damage done to the car. My mothers jaw dropped, she couldn't believe it. He eventually won the case and we ended up paying for the damage to the car.

Moral of the story? Pedestrian doesn't always have the right of way, and make sure you get the signal to cross from the light and not let some dip**** wave you down to cross the road.
A friend of mine was too tipsy to drive, so he walked home from a New Year's Eve Party. While crossing a street, he got hit by a Pathfinder going about 65 MPH in a 30 MPH zone. He recalled trying to jump, but got clipped in the legs and his head and chest smashed into the windshield. When the cops arrived, she actually tried to say he jumped in front of her car. That didn't hold up when the skid marks showed 60-70 MPH. He was in a coma for about two months, but came out of it and, amazingly, made a full recovery after about 3 years of physical therapy. The lady that hit him didn't visit him in the hospital once. She didn't even send flowers or a card. Long story short, she insisted it was his fault during the entire trial. In the end, he got his hospital and therapy bills paid and was awarded $200,000 for pain and suffering.

If I was in that lady's shoes, I would've visited at least once a week. The amount of guilt would be unbearable if I didn't. Some people just don't give a **** about anyone but themselves.

The utter callousness and lack of remorse of this screams ASPD or NPD.

You can just hear NPD character Patrick Bateman making this kind of demand and rationalizing it.

Ya it's quite scary that there are a lot of sociopaths and psychopaths walking around without taking any medication or going through therapy. Still is it there for being born with a disorder that makes them selfish? I think it's the parents fault for not properly being them up.

Officially there is no 100% agreed on reason for Cluster B Personality Disorders coming about Nip/Tuck.

Just a lot of good competing theories with their own varying amounts of evidence mostly centering on brain trauma occuring at a young age either through bruising in the womb or simply changes in the brain due to psychological trauma at a young age.

Yes.

On the surface talking to one of these people you may be fooled into thinking that they are a normal healthy mature adult but really they only possess the maturity development of a child and to believe anything else about them means you've simply been fooled like everyone else to believe that they are normal due to their high degree of intelligence and mimicry skills.

You see they watch normal people's reactions to certain situations to learn how to behave and blend in to society without detection to what they really are.

They are for all intents and purposes emotionally color blind which is what creates the need to mimic.

Sociopaths can indeed be made from a horrifically traumatic early parental (or lack thereof) environment that causes them to shut down their emotions outside of their control to survive but you should also keep in mind that the sociopaths that are simply born as what they are can be raised in the most loving and supportive of homes and still grow up to become a violent brutal remorseless criminal because that is usually where the condition itself leads them to go regardless of how well they were raised.

To be a sociopath though they have a tremendous need for control so some may give up a life of crime in order to reduce stress and also because if they are caught and imprisoned they are controlled by the state and no longer can do what they want.

Others simply change venues to carry out their crimes in such as moving on from street crime to white collar crime.

Think Enron.

Robert Hare the world expert on them has a book out about the sociopathic businessman called "Snakes in Suits".

Traditional therapy and medication only makes them worse sadly.

Medication only serves the purpose of getting them high it has no function in removing sociopathy from a person.

And therapy only helps them to better learn how to mimic people.

Maybe I'm a B Cluster baby but it did sound like the kid shared fault in crossing the roadway without looking. Unless we assume the traffic officials in Spain are completely incompetent it's instructive to notice both parties were declared at fault.

Not sure of the exact situation, but it seems like the insurance company should be the one suing. Not sure how Spanish insurance works, but why is the guy the one that gets the money.

If they were both at fault, and the insurance company had to pay for the death, they should be able to recover the costs of fixing that guys car, if thats what happened.

The pedestrian made a mistake, and paid the cost with his life. Just because the results of his mistake were worse than the other guys, doesn't make the other guy wrong.

To really make a judgment, you have to know the traffic laws in Spain.

The guy has every right to his money. If you are dumb enough to ride a bike in Madrid you should at least watch where you are going. Obey the rules of the road or suffer the consequences. Just because he got crushed doesn't mean he is some innocent saint.

There is a lot of sad s--- going on in this world. Some of it directly affects you. Yet, this trivial matter gets the attention of the numb masses.

He was in blatant violation of the law. He doesn't deserve a penny, if this had happened in the US he'd be in jail on Murder 3 if not Murder 2 (considering triple digits). Oh and he had been drinking.

Have you ever had a car drive by you at 100mph? In the city? I highly doubt you would see it, or be able to estimate its speed and its arrival time.

Get real.

100mph? That converts to what, 160km/h

That's about as fast as my car can go before it starts to vibrate, and I can count the times I've driven that fast on one hand. Up over 100-120mph driving starts to get dangerous with other cars on the road, throw corners and turns/city roads in there and its a recipe for disaster. And he was drinking?

IMO that wasn't an 'accident' at all, any more than trying to walk blindfolded across a 6 lane highway and getting struck by a car is an accident.

again IMO he should be put on trial in Singapore, see what their justice system will do for him...

haha, and he wants to sue for money? He'd have a hard time wanting anything if he went through their courts.

First I'd like to know how that speed was measured, second if you've ever driven in Southern Europe you know they have a different practice WRT speed laws and certainly pedestrians than here in the US.

Try some of the things pedestrians do here in Italy and you will almost surely get a free ride to the hospital.

Yeah, dumb to cross in front of a fast moving car even if you're not blindfolded.
