Some people wait in jail for a longer time than the maximum punishment for their alleged crime, before they even get their first hearing. My state eliminated cash bail recently for reasons like that.

The cops should have never arrested and charged him in the first place. If there's a surveillance video available, they should have watched it before arresting the guy.
