assault charge..lol

so few weeks ago i got an assault charge,and uttering death threats. cept the threats are a lie, kid who ratted made that **** up, which really pisses me off..

i live in Canada. Clean record. don't do drugs, pretty solid group of friends-meaning we aren't a bunch of **** ups who are unemployed etc..

im going to see a counselor person in a few days to talk bout whatever. i think it'll look good to the judge.

so i have 2 questions.

1- can i travel out of Canada right now?or do i have to work on getting a pardon?

2- What will the charges be?
fines? volunteer hrs?
iv been told no jail time..


any advice is helpful, thanks. and yes,i know it was ****ing dumb to do. wasn't thinking, just wanted to dude to shut his mouth

With your record, I can see the ADA's throwing out the communicating threats charges easily. I've seen it happen plenty.

assault can vary. If you have already been charged you need to lawyer up fast and listen to what you lawyer says. Trust me on that, these cases can really spiral out of control fast and you might be facing a lot more time than you realize at the moment.

You have to have your lawyer look into things. And if you want to present any evidence regarding your character or whatnot you should have your lawyer present it because it looks better and he will know how to communicate with the prosecutors office.
 

What happens, IN HER MIND, is that she comes to see you as WORTHLESS simply because she hasn't had to INVEST anything in you in order to get you or to keep you.

You were an interesting diversion while she had nothing else to do. But now that someone a little more valuable has come along, someone who expects her to treat him very well, she'll have no problem at all dropping you or demoting you to lowly "friendship" status.

i have never been charged before. court soon. no lawyer. i have 2 reference letters, going to see a counselor, and got a job since the incident

If it's anything like the U.S. (preface every sentence I type with that thought), your first court date will be to enter a plea. If you plead 'not guilty,' then they set a new date for your trial. Nothing happens that day except entering the plea. In my locale, there is a 1-year wait to get a trial. You can let the judge preside or have a jury trial (check your local rules).

If you plead 'guilty,' then the next part is receiving your sentence. Sometimes you have to come back, sometimes they do it that day. The things that you are trying to do to look good are really more relevant to sentencing. They're probably not going to be relevant to proof of your guilt or innocence. Ask the government's attorney or Assistant District Attorney before the pleading what they are offering in exchange for a guilty plea. There will typically be a standard deal that everyone gets, where they lessen the charges in exchange for a guilty plea.

When you get to court, be sure to check in on either the first or second docket call. That is basically a roll call of everyone who is scheduled to be in court that session so just call out your name when they announce your case. If you don't, you will be issued an OFA (order for arrest). Until then, you can travel if you want just be there on time to court.

If you have a clean record the judge might me lenient on you. Just hope for the best.
