Got charged 4 possesion of weed--but i was just high--

Guys please take me seriously about this. So today me and 2 other friends were smoking a blunt(weed). Cops came and one of my friends swallowed the blunt, but the other person still had some weed with him. They charged with the one who had weed with possesion too, but me and the other friend who were just high got charged with it too. Me and him didn't even had crumbs on us, NOTHING, we were just high...and so they decided to give us POSSESION OF MARIJUANA. The friend who had the weed, took all the blame, but we got charged ALSO, WTF?!!?

Please how can i fight this at court??

Hire a lawyer.

If its a first offense, it won't be that serious even if they find you guilty.

Were they city cops? If it is a municipal ordinance that they cited you for breaking and only carries a fine, then it is much harder to get out of it. In my town, pot arrests typically went unprosecuted due to the expense and trouble involved for the state. But now that it is a city-issued ticket, offenders do not get a public defender and don't get much of a trial at all. That is a commonly unknown side effect of making pot a ticketable expense - defendants lose a lot of their rights to a lawyer and a trial, so pretty much you just have to pay the money, which is the point of all of this.

Ask for drug court or a pre-trial diversion docket. Many counties/cities have programs set up that divert first time narcotics offenders to a separate docket, where they are offered opportunities at counseling and treatment instead of punitive sanctions. Once you complete the requirements of diversion court, the charge is wiped from your record.

If they don't have that, it might just be cheaper to pay the ticket out. Once you go to court, if you're found guilty you'll likely be assessed court costs in addition to your fine -- and court costs can, in some places, include the $100+ the state spends on getting the weed tested at a lab to verify that it is marijuana.

Get a lawyer who deals with drug cases. You may be able to beat this. Did they do any type of a drug test on you? What is the evidence. You may be able to get the charge dropped in exchange for going to rehab. You may have to get pretrial intervention if the case looks like you will have to plead guilty, but if your lawyer can get the case dropped that is what you should do, because the pretrial thing is only a one shot deal. You may need it in the future.

I don't know what it's like where you live, but you will need to get at least a grand up front and then make payments to your lawyer. But it will be worth it. You will want to act like you've gone straight and you probably want to stay straight for a while, at least until this passes, but it sounds like you live in a place that is really strict on weed. That's too bad, same where I'm from. I want to move to Denver or somewhere where weed is not thought of as so evil, but in the mean time I'm very careful and pretty much do not smoke at all. This sht comes back to haunt you, so you want to get it off your record. I'm telling you, a little possession charge like this can be hell for you in the future, so get it taken care of.

Its possible. Just makes it a lot tougher as you have a LOT of other applicants that haven't gotten arrested for posession.

Complicity laws in almost every state make it a crime to aid or abet another in the commission of an offense. If he's participating in the use of the marijuana, he's just as guilty of "possession" as the person who the weed belongs to.

If the cop saw him smoking weed, they have a case (based on the found marijuana in the friend's pocket). If the cops smelled weed and he admitted to the police he'd been smoking, they have a case.

One thing I remember from a class on constitutional law is how if friends are riding along in someone's car, the car is pulled over by the police and the police conduct an illegal search, if weed is found in the backseat then the owner of the car (presumably the driver) will knock down any charges (for the illegal search) but all the passengers can be prosecuted for possession (because you don't have a reasonable expectation of privacy being on someone else's property).
